Terms & Conditions
Last updated. September 30, 2026
Parties and authority. Checking the box is acceptance. In these Terms, "you" and "customer" mean the company on the account, except where a sentence states a personal duty. If the person checking the box has authority, that check binds the company, and the company is responsible for payment. The same check binds that person personally for use of the account: keeping credentials confidential, submitting accurate information, and activity under that login. It does not make that person a personal guarantor of the company's invoices or other debts when the person had authority to bind the company. If the person checks the box without authority to bind the company, that person is personally responsible for payment of the jobs submitted under that acceptance.
Services. Find My Damage provides estimating, supplemental estimating, damage documentation, weather and market-cost support, and other portal work you request. The work is professional support for your own jobs. It is not a construction contract, not a bid to the homeowner, not insurance-coverage or claim-settlement advice, and not a promise that a carrier will approve or pay any amount. You remain the contractor of record with the property owner and the carrier.
Your information. You must give accurate property, policy, scope, photo, and claim information, and you must have the right to upload homeowner and claim data for the job. Find My Damage may rely on that information. You are responsible for how you use a deliverable with a carrier, homeowner, or appraiser.
No extra promises. You acknowledge that you are not relying on any statement about results, timing, or claim payment that is not written in these Terms or on the invoice. This does not excuse fraud.
Warranties. Deliverables are professional opinions. Except for a promise written on an invoice, services and deliverables are provided as-is. Find My Damage disclaims warranties of merchantability, fitness for a particular purpose, and any particular insurance or claim outcome.
Payment. You agree to pay Find My Damage for every project, job, and request submitted on the account, and for related work the account asks for, at the price on the invoice or in a written quote. If the invoice and these Terms conflict on price or due date, the invoice controls. If no due date is stated, payment is due on receipt. A carrier delay, denial, or underpayment, or a homeowner's refusal to pay you, does not reduce or delay what you owe. Work already performed is payable if you cancel or stop responding. You may not withhold or offset except for the part of an invoice you dispute on time under Invoice disputes. Find My Damage may apply payments to the oldest invoices. Unpaid amounts accrue interest from the day after the due date at the lesser of 18% per year or the highest rate Texas law allows for this account. A late charge printed on an invoice is payable to the extent Texas law allows. You pay collection costs and reasonable attorneys' fees incurred to collect amounts owed, including on appeal. Taxes are extra when required.
Invoice disputes. To dispute an invoice, send written notice within 15 days after the invoice date, identifying the amount and the reason, to Find My Damage at the address below or to the billing email on the invoice. Find My Damage will review the notice in good faith. Amounts not identified in that notice are due. Undisputed amounts stay due while a dispute is open. This is a condition of holding back money. It is not a release of a separate claim filed on time under Court, jury, and fees.
Mediation. Before you file a lawsuit about the work, the deliverables, or these Terms, you must give written notice and mediate in good faith. Mediation is in Wise County, Texas, or by video. The parties have 10 days after the notice to choose a mediator. If they do not, either party may ask the American Arbitration Association to appoint one under its commercial mediation procedures. The mediator's fee is split equally. Each side pays its own lawyers at mediation. Mediation is required before filing suit, except as stated in this section. Communications in mediation are confidential under Texas Civil Practice and Remedies Code chapter 154. The mediator will not be a witness. A settlement is binding only if it is signed. Find My Damage may sue to collect an invoice without mediating first. Either party may seek a temporary restraining order or temporary injunction for misuse of the portal, confidentiality, or work product. Either party may file sooner if a legal deadline would expire within 30 days, and then a non-collection case is stayed for mediation. A party that refuses to mediate after a proper request pays the other side's reasonable attorneys' fees for a motion to abate or dismiss on that ground.
Court, jury, and fees. After mediation, or immediately for a collection claim, exclusive venue is the state courts sitting in Wise County, Texas. If a claim is properly in federal court, exclusive venue is the United States District Court for the Northern District of Texas, Fort Worth Division. You consent to personal jurisdiction in those courts and waive forum non conveniens. Texas law governs, without conflict-of-law rules. Filing in a different court entitles the other party to reasonable attorneys' fees for the motion to dismiss or transfer. The prevailing party recovers reasonable attorneys' fees, court costs, and fees on appeal. On a collection claim, Find My Damage is the prevailing party if it recovers any unpaid amount. Claims by the customer against Find My Damage must be filed within two years after the deliverable was provided or the invoice date, whichever is later. If Texas law requires a longer period for a particular claim, that longer period applies.
Jury waiver. Each party knowingly waives any right to a jury trial in a dispute arising out of these Terms, the portal, or a job.
Limitation of liability. The two limits in this section apply to ordinary negligence and to every other claim that is not gross negligence or willful misconduct. First, Find My Damage's total liability arising out of a project is the fees the customer actually paid Find My Damage for that project. Second, Find My Damage is not liable for consequential, incidental, indirect, special, exemplary, lost-profit, or claim-outcome damages, including a denied, delayed, or reduced insurance claim, even if advised of the possibility. Gross negligence and willful misconduct are outside both limits: neither the dollar cap nor the exclusion of those damages applies to gross negligence or willful misconduct. Neither limit applies to amounts the customer owes Find My Damage.
Business customer. You are buying these services for your commercial contracting business.
Indemnity. The customer will defend and indemnify Find My Damage and its owners and staff against third-party claims, damages, and reasonable attorneys' fees to the extent they arise out of the customer's use of a deliverable, information the customer supplied, the customer's work or statements to a property owner, carrier, or appraiser, or the customer's lack of rights in uploaded material. This indemnity does not require the customer to indemnify Find My Damage for Find My Damage's own negligence, gross negligence, or willful misconduct. It covers third-party claims only. The customer may not settle a covered claim in a way that admits fault by Find My Damage or imposes an obligation on Find My Damage without prior written consent, which will not be unreasonably withheld.
Work product. You may use the deliverables for that project and its insurance claim. Find My Damage keeps its methods, templates, price data, software, and portal. You will not resell a deliverable as a standalone product.
Confidentiality. Each side will protect the other's non-public business information and use it only to perform the job and administer the account. You are responsible for having permission to upload homeowner, policy, and claim data.
Accounts. Keep your login credentials confidential and notify Find My Damage of unauthorized use. Find My Damage may suspend access for nonpayment or misuse. Suspension does not cancel amounts already owed.
Relationship. The parties are independent contractors. Nothing in these Terms creates a partnership, employment, or joint venture. Find My Damage is not your subcontractor to the homeowner unless a separate written agreement says so. You carry your own insurance for your contracting operations.
Changes. Find My Damage may update these Terms by posting a new version with a new Last updated date. A job submitted after that date uses the new Terms. A job already submitted keeps the version accepted for that job, except a change required by law.
Previously submitted jobs. Acceptance of these Terms does not, by itself, acknowledge a specific historical invoice balance or apply new charges, liability limitations, indemnities, or dispute provisions to previously submitted jobs. Existing payment obligations remain governed by the agreements and law otherwise applicable to them. The company and Find My Damage may separately enter an electronic acknowledgment or payment agreement identifying prior jobs or invoices. That agreement governs the identified obligations to the extent expressly stated.
Electronic records. Checking the box is acceptance by the company and by the individual user, as described in Parties and authority. Clicking Login, Register, or Submit without checking the box is not acceptance. The same checkbox is the acceptance when creating an account, signing in, and submitting a job. That acceptance is effective under the federal E-SIGN Act and the Texas Uniform Electronic Transactions Act. Portal logs, the stored Terms version, and invoices are the record of acceptance. The parties agree those records may be offered as business records in mediation and in court.
General. These Terms, together with the invoice or written quote, are the entire agreement for portal jobs. If a clause is unenforceable, the rest remains in effect. A waiver must be in writing and is not a continuing waiver. Find My Damage may assign these Terms. You may not assign the account without prior written consent. Payment, disputes, mediation, venue, jury waiver, limitations, liability, indemnity, confidentiality, and work product survive the end of a job or of access to the portal.
